Federal court rejects New Jersey Democrat congresswoman’s bid to drop ICE assault charges
Speech or debate is not a shove at the gate. The Third Circuit said 2-1: stand trial.
Summary
- Just the News reports a 2-1 Third Circuit panel on Wednesday refused to dismiss assault charges against Rep. LaMonica McIver stemming from a June clash outside Newark's Delaney Hall ICE facility.
- The 49-page majority said the Speech or Debate Clause does not cover the confrontation and that DOJ is not charging a legislative act. Judge Thomas L. Ambro dissented.
- Justice charged McIver with assaulting officers at the gate. Newark Mayor Ras Baraka was arrested in the same protest wave. DHS policy requires lawmakers to request facility visits at least seven days ahead.
- McIver called the case politically motivated and said the ruling emboldens enforcement. A brief from 20 former members warned of a chilling effect on oversight.
Commentary
A detention officer still tastes asphalt dust and holds a gate that a camera already turned into a set. He did not clock in so a clause about debate could erase a shove.
That is the gap. Forty-nine pages. Two to one. Seven days' notice. The honest dad already paid the badge. The presser paid the clip.
Look every officer who still locks a sally port in the eye and answer this: if a gate scuffle is oversight, who still owns the fence?
Comments
2-1 and 49 pages is not a vibe. It is a trial date.
I stood a gate. Speech or debate does not cover a shove.
Seven-day notice is the policy. June was the clash. Wednesday was the panel.
Allied MPs do not call a gate rush a hearing. Copy the discipline.
Delaney Hall. Baraka arrest. Ambro dissent. File those nouns.
I still clock a plant gate. I do not get immunity for a shove.
A kid watching the clip should see a statute, not a costume.
A republic that immunizes a gate rush will not hold a port.
JTN printed 2-1, 49 pages, seven days, and Delaney Hall. Argue those nouns.
Keep the charge. Hold the trial. A fence is not a podium.
