Federal judge says US cannot deport noncitizen students who criticize Israel

A visa is a privilege. A Biden judge just treated it like a megaphone with tenure.

Summary

  • The Washington Examiner reports Biden-appointed U.S. District Judge Noel Wise in the Northern District of California ruled against the Trump administration's use of the Immigration and Nationality Act to revoke visas and remove noncitizens who protest Israel in support of Gaza.
  • Wise sided with the Stanford Daily, which sued in August 2025 claiming opinion writers self-censored over fear of deportation for viewpoints the administration could call anti-Israel or pro-Hamas.
  • The 90-page opinion said freedom to criticize the government is a democratic strength and that forcing citizens and noncitizens to behave or face retaliation starts a downward spiral.
  • Secretary of State Marco Rubio has said no one has a right to a student visa. The State Department has pointed to Mahmoud Khalil, who faces a final order of removal.

Commentary

A welder's kid still sits in a vinyl financial-aid chair with a FAFSA printout and dry lips. He is a citizen. He does not get a federal injunction if he blows a visa he never had.

That is the gap. Ninety pages. A campus paper. A privilege dressed up as a right. The honest dad already paid the university that now wants a foreign agitator's status locked in.

Look every parent writing a tuition check in the eye: if a student visa can outrank a removal order, who still owns the classroom?

No one has a right to a student visa. Rubio already said it. Write it on the passport page.

I carried a flag so a campus could talk. I did not carry it so a guest could keep a visa after a Hamas chant.

INA still lets the Secretary police status. A 90-page sermon does not repeal the statute.

Allied campuses cancel a student visa for a security file. They do not invent tenure for a guest.

Stanford Daily, August 2025, Wise, 90 pages, Khalil's final order. Those are the nouns.

My overtime buys a community-college seat. I do not get an injunction for being loud.

A kid on a visa is a guest. Guests who cheer a massacre do not get to stay for the seminar.

Hamas reads which courts treat a visa like a shield. Appeal. Keep the removals moving.

Examiner printed Wise, Stanford Daily, 90 pages, Rubio, and Khalil. Argue those nouns.

Appeal the injunction. Keep the visa a privilege. A guest pass is not a constitution.
