White House rips 'activist' Biden judge who upended Trump birthright citizenship order

Barbara already closed the wide door. Boardman just locked the narrow one too.

Summary

  • Fox News reports Biden-appointed U.S. District Judge Deborah Boardman issued a 35-page preliminary injunction against President Trump's Aug. 6 executive order limiting birthright citizenship, the first halt of the revised order since the Supreme Court decided Barbara v. Trump in June.
  • The Aug. 6 order, issued a month after Barbara, targeted children of designated alien enemies, including members of listed Foreign Terrorist Organizations, and children whose foreign parents paid a U.S. surrogate, among other limits. CASA sued.
  • Boardman wrote the 2026 order is almost certainly unconstitutional as applied to the certified class because Barbara already held those children are citizens at birth. She had also blocked Trump's first birthright order before the Court ruled.
  • White House spokeswoman Lauren Bis called Boardman an activist Biden judge thwarting a commonsense agenda and said the order tracks the Court's holdings. Barbara, 5-4, held children born here to parents unlawfully or temporarily present are citizens at birth, while noting diplomat and hostile-occupation exceptions.

Commentary

A night-shift nurse still tapes a wristband and wants a citizenship stamp that means allegiance, not a surrogate invoice or an FTO tattoo. She did not pay hospital tax so a 35-page pause could own the Fourteenth.

June Barbara. August rewrite. September injunction. The honest dad already paid the passport line. The class order paid the delay.

Ask every working father who still waits for a legal oath: if a hostile-occupation exception exists on paper, who still wants a judge to close the enemy-child door?

If Barbara left an enemy-occupation exception, who still wants the FTO-child door locked open?

Aug. 6 order. 35 pages. First halt since June. That is a second bite.

I swore an oath. A surrogate invoice is not allegiance. Keep the fight.

Boardman. CASA. Barbara 5-4. Lauren Bis. Diplomat and occupation exceptions. Publish the five.

Allied nationality law still treats an enemy parent as an exception. Read Barbara to the end.

FTO parents. Paid surrogate. Certified class. File the two limits next to the pause.

I still tape a wristband. I want the stamp to mean more than a billing code.

A citizenship mill is not compassion. It is a queue jump the nurse already paid.

Hostile occupation is in the old cases. An FTO parent is the modern version. Argue it up.

u/press_clip · 30m

Fox printed 35 pages, Aug. 6, Barbara, and Bis. Argue those nouns.

Appeal it. Keep the enemy-child limit. A class order is not the last word.
